Terms of Service

These Terms of Service ("Terms") govern your use of dailymlplays.com and its related services (the "Service"), operated by Bautista Planning and Analytics, LLC ("we," "us," "our"). By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.

Eligibility

You must be at least 18 years old, or the age of majority and/or the minimum legal age for sports wagering in your jurisdiction (whichever is higher), to use the Service. Sports wagering is illegal in some jurisdictions and regulated differently in others — it is your responsibility to know and comply with the laws that apply to you, including whether you may legally place a wager where you live. We make no representation that the Service, or any activity you engage in after using it, is appropriate or legal in any particular jurisdiction.

Account Registration

• Accuracy: you agree to provide accurate, complete, and current information when creating an account, and to keep it up to date.
• Security: you are responsible for safeguarding your login credentials and for all activity under your account. Let us know right away if you suspect unauthorized access.

Subscriptions & Billing

Paid access to the Service is offered as a monthly plan billed every month. The price is shown on our pricing page at the time you subscribe. Payment is processed by Stripe.

Your subscription renews automatically at the end of each monthly billing period at the then-current price, and your payment method is charged at the start of each new period. You can cancel at any time through your account's billing portal; cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, payments are non-refundable, including for partial billing periods.

Permitted Use and Restrictions

You agree not to:

• use the Service in a way that violates any local, state, national, or international law;
• resell, redistribute, republish, or scrape content from the Service without our permission;
• attempt to circumvent subscription access controls, or share your account with others;
• reverse engineer, decompile, or attempt to extract the source code of the Service or its underlying models;
• introduce malicious software or viruses, or use automated systems such as bots or scrapers, without our explicit permission.

Intellectual Property

The Service — including its analysis, design, source code, logos, and underlying models — is and remains the exclusive property of Bautista Planning and Analytics, LLC, and is protected by copyright and trademark laws. Your subscription gives you a personal, non-transferable right to use the Service; it doesn't transfer ownership of anything to you.

Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including accuracy, completeness, or fitness for a particular purpose. Statistical models and data pipelines can have errors, gaps, or delays — we don't warrant that any information on the Service is error-free or current.

Limitation of Liability

To the fullest extent permitted by law, Bautista Planning and Analytics, LLC and its owners, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or use, or any financial losses connected to a decision you made using information from the Service — arising from your access to or inability to use the Service. Our total liability for any claim arising out of the Service is limited to the amount you paid us in the 3 months before the claim arose.

Indemnification

You agree to indemnify and hold us harmless from any claim or demand arising out of your use of the Service or your violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination your right to use the Service ceases immediately. You may stop using the Service and cancel your subscription at any time.

Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles, and any dispute will be resolved in the state or federal courts located in Oregon.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, provide notice before the new terms take effect. Continuing to use the Service after a change means you accept the updated Terms.
